Agency representation mandate

The Agency may, in your name and on your behalf, on Swiplay: join campaigns (Standard tier) or apply to them (Selection and Review tiers), and accept their brief and tier rules; submit or withdraw your content, accepting the campaign’s collaboration contract for you, and send it for review; claim game keys; manage your profiles and, where it is open to you, your public page; respond to the direct offers addressed to it and provide the code or advertising authorisation. These acts bind you as if you had performed them. Swiplay keeps a record of those performed by the Agency.

You may perform all of these acts yourself, except responding to direct offers where Swiplay reserves them to the Agency. Only you may accept the Swiplay terms and their updates, link or unlink your networks and your Twitch and Steam accounts, change your email address, request the end of the representation, exercise your data protection rights and delete your account. You remain the sole publisher of your content and responsible for its advertising disclosures.

Each video earns, for its whole life, for the one who was the beneficiary when it was submitted:

• video submitted during the representation: to the Agency, even after the representation ends. Swiplay pays these sums to the Agency, which discharges it towards you; what the Agency pays you back depends on your contract, outside Swiplay;
• video submitted before the representation: to you, including for the views made during the representation. These sums are never paid to the Agency: they are paid to your own payment account, through a withdrawal started when you join and then as soon as possible, with the usual fees and without any minimum amount.

A direct offer earns for the Agency if the agreement is reached during the representation, even if you are the one who accepts it, and for you otherwise.

The Agency acts within the limits of this mandate and in your interest, reports to you on what it does in your name, avoids conflicts of interest, keeps your information confidential and is liable towards you and towards Swiplay for the acts performed for you.

The mandate lasts as long as the representation is active. You may request its end from your account settings: the Agency has 72 hours to accept or contest it; without an answer, the representation ends. If it contests it, you may renew your request or refer the matter to Swiplay. The Agency may end it at any time, and Swiplay in the cases provided for in the Terms. After the end, the rules of point 3 keep applying; the videos you submit afterwards earn for you directly.
