Creator Terms of Service

Rules for creators earning on Swiplay: how we move your money, how we stay compliant with French and EU law, and what we expect from you in return.

1. Who we are and what we do for you

Swiplay operates a marketplace that connects video game studios (clients) and content creators (you). When a studio pays a campaign, Swiplay acts as payment agent (mandataire) and distributes the earnings to creators on the studio's behalf.

Swiplay does not hold a payment institution license. Funds destined for creators are collected and safeguarded by our partner Stripe Technology Europe Limited, authorised under the EU Payment Services Directive 2 (PSD2) and supervised by the Central Bank of Ireland.

Your creator balance is held in dedicated safeguarded accounts at Stripe. In the unlikely event Swiplay becomes insolvent, your funds remain your property and are segregated from our operating accounts.

2. Marketplace rules

You submit videos to campaigns published by studios. Each submission goes through the following lifecycle:

  • J+0 to J+2: the studio has 48 hours to validate, refuse, or take no action. No action = auto-validation.
  • J+2: your credits become validated. They are not yet withdrawable.
  • J+2 to J+9: seven-day maturity delay. The studio may still escalate a grave issue (a report) during this window. Your credits remain frozen from your perspective but are already yours.
  • J+9: final lock. No further studio action is possible. Credits become mature and appear in your withdrawable balance.

Studios may only refuse or report a submission for one of the six closed-list reasons per action type (off-topic, insufficient quality, guidelines breach, inappropriate content, duplicate, plagiarism for refusals; negative content, deletion, artificial views, plagiarism, fraud, late guideline violation for reports).

Swiplay is the sole and final arbiter of every refusal or report. We respond within 48 hours. If Swiplay rejects the studio action, we apply the silent protection policy: you are not notified of rejected actions. We only notify you of confirmed refusals or reports.

3. Payouts

Minimum withdrawal is 50 € in mature balance. Payouts are triggered by you from your dashboard and processed through a Stripe Connect Express account opened in your name. Swiplay covers Stripe processing fees (0.25 € + 0.25%).

To receive payouts you must finalise your Stripe onboarding within 60 days of signup. After this deadline, your account is progressively blocked: at 1 500 € of pending earnings or 25 transactions, you can no longer submit new videos until Stripe is active.

4. Your fiscal obligations

You are solely responsible for declaring the income you earn on Swiplay to the competent authorities (URSSAF, income tax, VAT if applicable, equivalents outside France). Swiplay does not withhold social contributions or income tax on your behalf.

As a Reporting Platform Operator under Directive 2021/514 (DAC7), Swiplay collects fiscal data at your first earning (name, date of birth, residence, tax identification number, IBAN) and reports your annual earnings to the French tax administration by 31 January each year. You will receive an individual recap before filing.

You commit to providing accurate, complete, up-to-date information and to updating your profile whenever your situation changes. Providing false fiscal information may result in account suspension and, in serious cases, reporting to the authorities.

5. Clawback and fraud

Swiplay may recover funds already paid or scheduled to be paid (clawback) in the following cases: proven fraud, artificial views, plagiarism, chargeback confirmed against a studio, clerical error. When possible the clawback is deducted from your next payout; otherwise we may invoice you.

We may suspend or permanently close your account in case of fraudulent behaviour. Swiplay is the sole arbiter of any litigation arising from your use of the platform.

6. Content and IP

You keep full ownership of the content you publish. By submitting a video to a campaign you grant the studio a non-exclusive licence to use the content within the scope defined in the campaign brief (repost, paid media, duration). The detailed rights vary per campaign and are written in the brief.

7. Changes and governing law

We may update these Terms. A new version (v2, v3, etc.) triggers a re-consent screen on your next login; continued use after 30 days without response is considered tacit acceptance of non-material changes.

These Terms are governed by French law. Any dispute shall be subject to the exclusive jurisdiction of the competent French courts.
